Welcome to MarkMate, an AI-powered essay feedback platform designed to support students and educators. These Terms and Conditions ("Terms") govern your use of the service. By accessing or using MarkMate, you agree to be bound by these Terms.
1. Educational Use Only
MarkMate is intended for educational purposes only. It is not a substitute for formal instruction or academic evaluation. Use of this service should complement, not replace, feedback from qualified educators.
2. Use by Minors
- MarkMate is only suitable for users over the age of 13.
- Minors (under 18 or under the age of digital consent in your country) must have specific parental or guardian consent before using MarkMate.
- Schools facilitating access must comply with all applicable data protection laws including but not limited to COPPA, FERPA and GDPR-K.
- Parents or guardians may review and request deletion of data in the user portal or by contacting contact@markmate.ai.
3. User Responsibility
- Feedback provided by MarkMate is AI-generated and intended as suggestions only. Users are solely responsible for:
- The final content of their essays.
- Evaluating the relevance and accuracy of suggestions.
- Consulting human teachers if uncertain about the output.
4. AI Disclaimer and Limited Liability
- MarkMate uses AI models that may produce inaccurate or hallucinated content.
- MarkMate does not guarantee the correctness or educational value of any output.
- To the maximum extent permitted by law, MarkMate disclaims liability for any damages, academic consequences, or losses arising from reliance on AI-generated feedback.
- Users must acknowledge these risks before use.
5. Intellectual Property
- User Content: You retain all rights to essays or materials you upload. By submitting content, you grant MarkMate a limited, non-exclusive, revocable license to process and analyze your content solely for the purpose of providing feedback.
- Service Content: All platform features and AI-generated text remain the intellectual property of MarkMate and its licensors.
6. Prohibited Uses
It is prohibited to:
- Upload content that violates laws or Microsoft's AI Code of Conduct . This includes but is not limited to content that is harmful, offensive, illegal, or violates intellectual property rights
- Use automated tools (e.g., bots, scrapers, crawlers) to access the service.
- Attempt to reverse-engineer or misuse the AI.
7. Data Protection and Privacy
- We take student and user privacy seriously. Please refer to our Privacy Policy below. MarkMate complies with GDPR and COPPA where applicable.
- We do not sell user data.
- Schools may request a Data Processing Agreement (DPA).
- You may request access, correction, or deletion of your data.
8. Accessibility
MarkMate aims to be accessible for all. If you encounter barriers using the platform, please contact us for support.
9. Changes to Terms
We may update these Terms at any time. If changes are material, we will provide notice and request renewed acceptance. Continued use after changes implies agreement.
10. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the State of New South Wales in the Commonwealth of Australia.
- Any disputes will first be resolved through informal negotiation.
- If unresolved, disputes will be submitted to binding arbitration, unless otherwise prohibited by law.

MarkMate uses infrastructure and AI models provided by Microsoft Azure OpenAI Services, which are subject to their Code of Conduct . By using MarkMate, you acknowledge and accept those third-party terms.
